The following terms and conditions will be applied throughout all the stages of the "amazing Experience Video Contest" (hereafter referred to as the “Contest”) organized by Tourism Authority of Thailand (TAT).

Qualifying Period
The Contest is open for submission from 1 May to 30 June 2008 11:59 PM (GMT +7), while the voting period is 1 May – 31 July 11:59 PM (GMT +7)

1. Eligibility for the Contest

•  The Contest is opened to any one around the world with any nationality.

•  All Contestants are required to fill in their true personal details (i.e. name, e-mail, country, gender, age, profession and address) in order to facilitate demographics data collation and for voucher/prize distribution(s), if any. Any invalid or incomplete entry will result in disqualification.

•  All Contest criteria have to be fulfilled. Failure to any may render submitted entry ineligible for voucher/prize consideration.

•  All the visitors require registering a log in ID in order to participate in the Contest.

•  Employees of TAT and their associated companies are not eligible to participate in the Contest.

•  Unoriginal entries and/or submissions will be rejected by TAT.

•  Each participant shall make full and honest disclosure of particulars as requested in the Contest. Any misrepresentation of any facts or particulars may result in disqualification, forfeiture or withdrawal of any prize won at the sole discretion of TAT.

•  All submitted artworks must be original efforts by the Contestants. TAT will not be held responsible for any originality and/or copyright dispute from artworks submitted by Contestants.

2. How to Enter

•  TourismThailand.org visitors can visit the amazing Experience Video Contest at http://amazingexperience.tourismthailand.org and submit a video which meets the required criteria by following the instructions on the Video Tab. For each submission the contestants will receive one entry into the Contest and will have a chance to win the prizes set forth (see “Prizes”).

•  Only originally created videos containing appropriate themed content (as determined by TAT, in its sole discretion), and submitted by clicking on the "amazing Experience Video Contest" button on the Video tab will qualify as entries into the Contest.

•  If you are not yet a Contest's Member, register by clicking at “Register” and follow the instructions to create a profile.

•  The Contestants may choose to show their profile publicly online or keep it as a private profile without access by anyone.

•  There is no limit to the number of videos a Contestant may submit.

•  After registering or logging in as a member, each Contestant will be directed to the main Contest page, where he or she may upload one or more videos for consideration for entry into the Contest by following the instructions on the particular page.

•  The receipt of an entry occurs only when a contestant submits a video during the entry period (May 1 to June 30, 2008) while all online videos submitted for entry must be received by 11:59 PM on the last day of the period.

3. Video Entries' Criteria

A video must meet the following criteria in order to be eligible for entry into the Contest:

•  The video should not be longer than 3 minutes and not larger than 50 MB.

•  The video must be uploaded through the Contest page in an appropriate format for display on the Video Tab. The range of video file formats the Contest accept are .WMV, .AVI, .MOV and .MPG which can be transferred from most digital cameras, camcorders and cell phones.

•  The video's content must relate to an appropriate theme set by the TAT for the Contest i.e. amazing Experience Video Contest.

•  The video should have been taken in Thailand within last three years time only.

•  The video taken should not be illegal i.e. does not include any reference to narcotics, prostitution, violence and crimes against the state or monarchy etc. (See “Limitations for Video Content")

•  The content of the video must comply in all other respects with the Rules and Regulations.

•  All the submitted video clips will be considered and examine for the appropriateness by the management team before letting it appear on the website.

4. Limitations for Video Content

•  Do not post any video containing pornography or child exploitation.

•  Do not post any video containing animal abuse, narcotics use or bomb making.

•  Violent videos of any kind are not allowed.

•  Respect copyright. Only upload videos that you made or that you have obtained the rights to use. That is do not upload videos that you did not make, or use content in your videos that someone else owns the copyright to, such as music tracks, snippets of copyrighted programs, or videos made by other users, without their permission.

•  We do not permit hate speech (speech which attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status, and sexual orientation/gender identity) in the video.

•  There is zero tolerance for predatory behavior, stalking, threats, harassment, invading privacy, or the revealing of other members' personal information. Anyone caught doing these things may be disqualified immediately.

•  Violations of the Rules and Regulations may result in a warning notification or may result in termination of your account and deletion of all your videos from the Contest. TAT decides whether we believe your violation of our Rules and Regulations should result in termination of your account. If you have an account terminated you are prohibited from ever signing up for any other contest of amazing Thailand by TAT!

5. Criteria for selecting winners

•  The winners of the Contest will be determined by the maximum number of votes with the maximum ratings received for each video. For e.g. if Mr. A receives 5 ratings from 5 voters and Mr. B receives 5 ratings from 10 voters, Mr. B will be declared as the winner by considering the higher number of votes.

•  The voting will be done by all the amazing Experience Video Contest mini site's registered members during the voting period.

•  Votes from logged in members will determine the repeated votes by the same member for the same video. If found, will be considered as only one vote.

6. How to Vote

•  In order to vote, a user may simply have to register to be the Contest member.

•  View one or more videos submitted by the Contestants that are displayed on the Contest Video Tab.

•  You may view videos any number of times.

•  It is not necessary for you to view all the videos before voting.

•  After you have viewed videos, you may vote for your favourite one by clicking on the appropriate number of stars (5 stars being the highest) under “Rate this Video” beneath the video player.

•  You may vote for more than one video.

•  TAT members, associated companies of the website or the Contest registered members and web site users may not attempt to increase the number of votes for any submitted video through the use of any automated, deceptive, fraudulent or other invalid means (including but not limited to automated click-generating software, macro programs, or internet agents).

•  Vote from the Contestant who submitted the video will not be considered to determine the winner of the Contest. Except otherwise prohibited by the official rules, there is no limit to the number of votes amazing Experience Video Contest Member can cast during the Voting Period.

•  For each voting submission, the voters may entitle to receive prizes through a lucky draw (see details in “Voting Requirements and Prize Distribution”)

7. Judging, Winner Selection and Notification

•  The voting period will be from 1 May to 31 July 2008 and the submission period 1 May to 30 June.

•  Three winners will be announced on 1 st August 2008 on the amazing Experience Video Contest mini site and will be sent an e-mail declaring as the winners.

•  Public voting mechanics and execution will be done at the sole discretion of Tourism Authority of Thailand.

•  Decision(s) made by TAT will be considered final.

•  Winners will be the Contestants whose eligible videos receive the maximum number of votes with the highest ratings during the Voting Period.

•  A Contestant can be announced a winner only for one video. In case a contestant is the winner for more than one video, TAT reserves the right to award him/her for only one video receiving the maximum number of votes with the highest ratings.

•  If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the TAT which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, TAT reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and select winners from among all eligible online entries received prior to and/or after (as appropriate) the action taken by TAT. Notice of any such action by TAT will be posted on http://amazingexperience.tourismthailand.org.

8. General

•  TAT will not be held responsible for any lost, late, incomplete, illegible, damaged or misdirected entries, or for any human or technical errors, failures or malfunctions in the transmission or receipt of details submitted through the Internet.

•  In the event, if the selected winner(s) of the Contest cannot be contacted at the e-mail address indicated within the entry form, or on informing the selected winner, if he/she does not reconfirm back within a given period of time, TAT reserves the right to declare and award an alternate winner instead

•  By participating in the Contest, participant agrees that TAT, their subsidiaries, affiliated companies and their respective advertising, promotion and distribution agencies, affiliates, officers, directors, and employees shall have no liability of any kind arising from or in connection with the acceptance, possession or use of the prizes awarded herein and acknowledge that said parties are not in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or law, relative to any prize including but not limited to its quality, mechanical condition or fitness for a particular purpose.

•  TAT reserves the right to substitute, vary or alter any of the prize(s) offered without prior notification.

•  TAT reserves the right, in its sole discretion and without any liability on its part whatsoever, to cancel, postpone, terminate, or suspend or in any other way cease the Contest at any time without prior notification.

•  Except where prohibited by law, a winner's acceptance of a prize constitutes permission for TAT to use such winner's name, address (city and state only), statements, photograph, voice and/or likeness for any advertising, trade and promotional purposes relating to the Contest and amazing Thailand campaign, future versions of the Contest or other amazing Thailand contests without further compensation, consideration, review or consent.

•  By participating in the Contest, all the contestants permit TAT to use their videos for any advertising, trade and promotional purposes relating to the Contest and amazing Thailand campaign, future versions of the Contest or other amazing Thailand contests without further compensation, consideration, review or consent.

•  TAT reserves the right to terminate the membership of any entrant in the Contest at any time for any reason, subject to the Rules and Regulations herein.

•  TAT reserves the right to amend or vary the Terms and Conditions of the Contest at any time without prior notification.

•  Non-compliance or breach of any of these Terms and Conditions shall immediately disqualify the participant from the Contest and further participation in any other contest organized by TAT.

CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, TOURISM AUTHORITY OF THAILAND RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

This Contest is governed by the laws of Bangkok , Thailand and is subject to all applicable federal, state and local laws and regulations.
